Tropicsurf Terms & Conditions

By booking with Tropicsurf and paying the non-refundable deposit or any further payments, the passenger acknowledges, understands and agrees to be bound by these booking conditions:-

ACCEPTANCE OF BOOKING: The booking shall be deemed confirmed and accepted by Tropicsurf upon receipt of the non-refundable deposit into Tropicsurf’s nominated bank account. Upon such time there is a legally binding contract between you (the passenger) and Tropicsurf subject to the terms and conditions in this agreement.

RISK ACCEPTANCE / ENTRY FORM: It is a condition of entry onto each trip that the risk acceptance and entry form must be read, signed and submitted to Tropicsurf before arrival. In booking with Tropicsurf the passenger acknowledges that all trips/tours involve inherent risks that may not be present in the case of conventional or less demanding holidays. In accepting the risk involved passengers acknowledge the decision to travel has been made after due consideration or relevant travel information and no liability exists to Tropicsurf or the service provider.

All passengers are required to complete and sign the Tropicsurf entry form and risk acceptance.

Any special requirements should be noted on this form.

PRICE AND VALIDITY: Be sure to check the currency of your chosen holiday. Costs included in trip are as per trip itinerary chosen and are current at time of quoting/booking. Trip costs are based on boat, air, land, fuel and currency rates. We reserve the right to change the price without notice prior to the departure of any trip should fluctuations occur in boat, air, land, fuel or currency rates. Some trip prices include taxes that are collected on behalf of local governments in the event that these taxes are altered we reserve the right to collect additional taxes without prior notice.

Not included in the trip cost (unless stated otherwise on the invoice) are airfares and airport taxes, passport and visa fees, travel insurance, excess baggage charges, gratuities to leaders/coaches/crew, extra meals not stated on itinerary, laundry, medical expenses, optional activities and trips and any items of a personal nature.

TRAVEL INSURANCE is compulsory. Tropicsurf offers competitive rates for surfers via our agents at Harvey World Travel in Noosa. Passengers are reminded that all baggage and personal belongings including boards are carried entirely at the passengers own risk. In the event of an emergency medi-vac, all expenses are to be borne by either the customer or their personal insurer. Tropicsurf is not liable for medical or evacuation related costs.

PAYMENT TERMS: Maldivian boats:- Deposit of 25%. Balance due 3 months prior to arrival. Some trips aboard Four Seasons Explorer may require deposit of 50% if stated in writing by Tropicsurf. Otherwise deposit is also 25%. Balance is due 3 months prior to arrival. Resorts:- Deposit of 25%. Balance due 3 months prior to arrival. Other boats:- as advised on invoice.

Booking amendments after deposit received will incur a minimum administration fee of $50, possibly more depending on the amendment.

CANCELLATION: Should you wish to cancel your trip written notification is required. The following penalties will apply:-

•    Deposits – All deposits are strictly non-refundable and non-transferable unless stated otherwise on invoice or agreed in writing by Tropicsurf’s Director.
•    3 months or more prior to departure – loss of deposit.
•    2-3 months prior to departure – 50% cancellation penalty of total paid.
•    2 months or less prior to departure – 100% cancellation fee.

Refunds are not available where written notice is not given or for any unused trip, accommodation or air services.

Tropicsurf will not be held liable for any delay in, change to or cancellation of trips due to unforseen circumstances beyond reasonable control of Tropicsurf. This includes but is not limited to war or threat of war, riot, civil strife, terrorist activity, industrial dispute, industrial or nuclear disaster, adverse weather conditions, fire, strikes, disease or Acts of God. In such an event it will be at Tropicsurf’s discretion to: offer an alternative trip/tour of comparable standard or; refund any unused part of the trip.

LATE PAYMENT: In the event of late payment according to the payment schedule above (or as stated otherwise on your invoice), Tropicsurf can no longer guarantee the booking as being confirmed. This is especially so with resort and airline bookings, where late payment may lead to automatic cancellations within their computer systems and without notification. In such an event, Tropicsurf will not be liable for cancelled bookings. We suggest you pay before the deadline to avoid disappointment.

CHANGES TO ITINERARY: Travelling with Tropicsurf requires a degree of flexibility, good humour and an understanding that the itinerary, accommodation, start or finish point and/or modes of transportation may change, even after a tour’s commencement without prior notice due to local circumstances. This may result in sailing and activity schedules, routes and ports of call to be altered in the judgement of Tropicsurf or the ships captain. Whilst we maintain high standards, in the event that a vessel cannot begin the trip at the agreed time or resume the trip due to technical problems, Tropicsurf will endeavour to restore the vessel within a reasonable amount of time. If unsuccessful, Tropicsurf will either obtain a replacement vessel* or cancel the trip and arrange passage to the departure point by another means at its discretion. Any additional costs incurred by these changes will be the responsibility of the passenger. Where international or local flights are delayed, cancelled or missed such that connections to the Tropicsurf tour are delayed or missed entirely, Tropicsurf bears no liability whatsoever. (*The replacement vessel may or may not have the same facilities as the original vessel.)

MINIMUM NUMBERS FOR TRIP DEPARTURES: Tropicsurf reserves the right to cancel with 60 days notice if minimum numbers required for the trip to operate are not reached. If this is the case an alternative date or trip will be offered or full refund made. This refund will be the limit of Tropicsurf’s liability. We are not responsible for any expenses incurred by the trip members in preparing for the trip including non refundable or penalty-carrying airline tickets, visa or passport fees or other trip related expenses.

HEALTH & FITNESS: It is your responsibility to ensure you have a suitable level of fitness to undertake your surf trip. Seek the advice of your doctor for specific health recommendations for travel to the region you are visiting and/or for any pre-existing health concerns. Tropicsurf reserves the right to ask for a current medical certificate stating you are fit to partake on a trip. Any medical expenses or related costs incurred during your trip are not the liability of Tropicsurf.

PASSPORTS AND VISAS: It is the passenger’s responsibility to carry a valid passport and have obtained the appropriate visas when travelling with Tropicsurf. Please ensure passports are valid for a minimum of 6 months beyond your date of arrival for the trip/tour.

RESPONSIBILITY: Tropicsurf acts as an agent in the arrangement of travel services and accepts no liability for any injury, loss, damage, accident, delay or irregularity that may arise to any passenger or third party resulting from the passengers or third party’s use. Some of our service providers (e.g. airlines/boats/resorts) will have additional booking conditions. As agents for these providers we do not take responsibility for any omission, default, neglect or accuracy of any information or statement made by them. Some service providers may require additional booking forms to be completed in order for reservation to be completed.

SEAPLANES: Seaplanes and local domestic airlines can give no guarantee of exact times or arrival or departure of any service and will not be liable for failure to make connections to other services.

SURF AND WEATHER: In the event of poor weather or poor surf, the passenger shall have no claim against Tropicsurf or the operators.
